The Twenty-eighth Public Meeting of the Judicial Proceedings Panel on Sexual Assault in the Military was held on March 10, 2017 in Arlington, VA.

Arlington, VA -The twenty-eighth public meeting of the Judicial Proceedings Panel (“JPP” or “the Panel”) was on Friday, March 10, 2017 from 9:00 a.m. to 4:00 p.m. at One Liberty Center, Suite 1432, 875 North Randolph Street, Arlington, Virginia 22203.

The Judicial Proceedings Panel is an independent federal advisory committee established by the Secretary of Defense in June 2014, in accordance with section 576(a)(2) of the National Defense Authorization Act for Fiscal Year 2013. The Judicial Proceedings Panel is tasked to conduct an independent review and assessment of military judicial proceedings for adult sexual assault offenses since Fiscal Year 2012, for the purpose of developing recommendations to Congress and the Secretary of Defense for improvements to such proceedings.

During the morning session, the Panel conducted deliberations on the Joint Service Committee on Military Justice's proposed amendments to Rule for Courts-Martial 1103A (Sealed exhibits and proceedings) and its Victims' Appellate Rights Report. The Panel received in-person public comments on these issues prior to its deliberations from Mr. Don Christensen, Protect Our Defenders. 

In the afternoon, the Panel received a presentation from the JPP Subcommittee on the Subcommittee's site visit observations regarding the Department of Defense withholding policy for initial disposition of certain sexual assault offenses, military attorney training, and Military Rules of Evidence (M.R.E.) 412 and 513 relating to evidence of a victim's prior sexual history and the psychotherapist-patient privilege. Finally, the Panel deliberated on M.R.E. 412 and 513 issues identified during the January 6, 2017, JPP public meeting.

This meeting was open to the public. Seating for the meeting was limited and available on a first-come basis.
